| Xavier unknowingly used an ineligible player in last week's Regional championship, and the WIAA ruled Thursday morning that Xavier was ineligible to participate Thursday in the tournament game at Appleton East. Xavier self-reported the infraction to the WIAA on Thursday, when the information first came to the attention of the Xavier A.D. and the Xavier Varsity Boys Basketball coach. The Hawks were to play against Fox Valley Lutheran on Thursday. Per WIAA rules, Little Chute took Xavier's place in the Sectional semi-final game played Thursday. XHS had upset Little Chute, 50-47, last Saturday night. The infraction took place on Saturday, Feb. 25 -- two weekends ago (not this past Saturday as was incorrectly typed here earlier), when a current Xavier player took part in a non-high school basketball game at Players Choice. Xavier had sought legal recourse, but a judge ruled about 6:45 p.m. Thursday in support of the WIAA regulations that prohibit a high school athlete from participating in an organized, non-school event in the same WIAA sport that the individual is currently participating. Also, the judge said there was no intent by the Xavier player, coaches, staff and administrators to circumvent the WIAA regulations. However, the judge quoted a previous court hearing that referenced preserving the 'status quo' of the WIAA events. In that case, a different judge determined an established, previous legal precedent in another recent situation involving the WIAA, a court in Wisconsin, and eligibility of a player at another high school in the state. Little Chute defeated Fox Valley Lutheran, 52-50, in that Thursday game. |
